AffittaSardegna is a Cooperative Society which, among other things, deals with the management of its own holiday homes or those of third parties. AffittaSardegna acts in the name and on behalf of the owner of the accommodation (whose name and personal details are indicated on the booking Voucher), by virtue of a specific contract of mandate previously conferred upon it, with the task of taking care of the management of tourist rentals (therefore, the receipt and, after obtaining the owner's consent, the confirmation of bookings, the procedures for withdrawal or cancellation of bookings) and the execution of the contract (delivery of the property and collection of the rental fee, taxes and any penalties, etc.), including the negotiation of any possible cancellation of the booking.), including the negotiation of any disputes or claims that may arise, with the exception of those concerning the suitability of the accommodation, liability for damages, which remain the responsibility of the owner; consequently, the rental contractual relationship commits only the Guest host (hereinafter: the Client) and the owner or lessor of the accommodation. Any and all responsibility related to any flaws, defects and/or non-conformities of the rented property or to any civil and criminal liability towards third parties arising from the reservation of the property or, however, to situations unrelated to the activity of AffittaSardegna, remains entirely the responsibility of the owner. The Client however must always refer to the present text of the “Terms and conditions” of booking which, by accepting them, he declares to know well.
The customer has the option of requesting to book the desired facility:
The booking is considered confirmed only when the Client receives a confirmation email from AffittaSardegna. The booking is subject to the prior confirmation of the availability of the accommodation by AffittaSardegna. Following the booking request, AffittaSardegna will send the Client the “booking form”. With the sending of the “booking form” the Client is obliged to pay the deposit indicated in the BOOKING FORM by bank transfer/credit card. Payment must be made in the manner and within the time period indicated in the “booking form” itself. The confirmation of the booking takes place when AffittaSardegna receives a copy of the receipt of payment of the deposit from the Client; this copy must be sent in any case within and not later than one week from the sending of the “booking form”. If this copy is not sent, the booking request will be considered cancelled. The balance must be paid in the manner and by the deadline indicated on the “booking form” itself, always by bank/credit card transfer. Failure to pay the above sums, in the manner and within the time indicated, will result in the legal termination of any relationship, also authorising AffittaSardegna to retain the sums received as per the tariff conditions applied. For booking requests made within 30 days prior to the start date of the stay, the relative price must be paid in full upon receipt of the “booking form”. The Client must always proceed with the full payment of the reservation price directly to AffittaSardegna which will issue a regular receipt/invoice of payment. All prices are in Euro. The reservations of the properties are nominative and cannot be transferred to third parties without the prior authorization of AffittaSardegna or of the owner of the property itself. In the case of luxury houses, the terms of payment, as well as the conditions of cancellation, may vary from case to case; they will be communicated from time to time.
The agreed price includes: accommodation in good condition, the normal consumption of gas, hot and cold water, electricity. The price does not include: bed linen, tablecloths, napkins, linen in general, any heating or air conditioning costs (if available), the use of infrastructure and/or external services (e.g. entertainment, umbrella hire, etc.) if stated on the website www.affittasardegna.it or in the “accommodation sheet” under the heading “notes”; the relative amounts will be settled on site. For some houses, depending on the municipality in which they are located, a tourist tax will be payable, to be paid in accordance with the procedures and times set by the municipality itself.
In the event that the Client asks for the modification of a booking already made and confirmed, AffittaSardegna is not in any case bound to the modification as requested and, therefore, in the event that it fails to obtain what the Client has requested, it cannot be held responsible in any way. The Client shall in any case be bound to pay the agreed price. In the event that AffittaSardegna modifies at the Client's request a booking which has already been made, the Client accepts any additional costs which will be charged exclusively to the Client.
The Client, after having proceeded with all the indicated payments, receives from AffittaSardegna a booking Voucher; the delivery of the keys of the booked accommodation takes place only upon presentation of the Voucher. The Voucher contains all the necessary information regarding the booked accommodation and its owner.
The delivery of the accommodation is carried out either by the owner or by one of his appointees or by one of AffittaSardegna's appointees; it is necessary to make contact by phone or email at least 14 days before the starting date of the reservation in order to agree on the modalities. Once the modalities of delivery of the accommodation have been agreed upon, the Client will have to go to the accommodation with his own means (always between 17.00 and 20.00 on the day of arrival). The accommodation must be vacated by 10 a.m. on the day scheduled for departure, in perfect order and cleanliness. In the event that the Client cannot be on time for the agreed appointment for the delivery of the keys, he/she shall always inform AffittaSardegna in order to arrange another appointment. Failing this, the Client shall be obliged, upon delivery of the keys, to pay 1.00 euro for every minute of delay with respect to the agreed appointment time. Upon arrival, the Client shall present the Voucher received from AffittaSardegna, pay the security deposit, pay the cleaning fee, any tourist tax and any incidental expenses requested on site (linen rental, extra services, etc.). Given the use of sea transport to reach and leave the booked accommodation, in case of need it is possible to change the arrival and departure times, subject to prior agreement with AffittaSardegna and/or the person in charge of delivering the house, and always in accordance with the needs and rights of other outgoing or incoming customers. The Client who will not occupy the booked accommodation within 6.00 p.m. of the day following the confirmed booking start date, without having given timely notice, shall be considered as renouncer and AffittaSardegna shall be authorized to keep what has been received from the Client. In case of late arrival or early departure, no refund is due.
A booked property cannot be occupied (not even occasionally) by a number of people (adults, children and infants) greater than the number indicated on the Voucher. AffittaSardegna or the owner may refuse the extra persons; if they are able to accommodate them, they may be invoiced separately on site. A number of people in excess of that indicated at any time during the stay is cause for contextual cancellation of the booking without any charge of compensation to AffittaSardegna. The property which is the subject of the booking must be used with care, also taking into account the tranquillity of the neighbourhood. AffittaSardegna may withdraw after the start date of the period of stay (or even before that date) when the Client (or those occupying the accommodation) does not make it possible to execute the contract, despite notice, or even behaves in such a way contrary to the contract as to justify the immediate termination of the booking. The Client shall be responsible for cleaning the kitchen equipment, cutlery and crockery. If the Client or other persons occupying the property with him/her cause any damage, this must be immediately reported to AffittaSardegna. The Client shall be liable for any damage occurring during his or her stay, but verified after the handover of the accommodation. In that case, the Client shall be liable to pay compensation for the damage itself, unless he/she proves that he/she had nothing to do with the event. Similarly, the Client shall be obliged to compensate for the financial damage caused by the fact that the damaged or unprepared accommodation cannot be delivered to the subsequent booking guests. The Client is responsible for the good outcome of the communications foreseen by the Public Safety regulations and must communicate to AffittaSardegna, immediately after having made the balance of the booking, his own tax code and the details of an identification document of all those who will occupy the accommodation. Only the persons whose details of the identification document will be communicated by the Client will be allowed access to the accommodation.
Upon handing over the keys to the reserved property, the Client shall pay the sum indicated in the Voucher to set up a non-interest-bearing guarantee fund to cover any breakage or damage caused by the Client to the property itself. The Client undertakes to take the utmost care of the property entrusted to him/her, its furnishings and domestic equipment. The booked property must be returned in the same state as it was found at the time of delivery, except for normal wear and tear. The Client is liable to the Owner of the property for damage caused to the property and/or the things therein that occurred during the booked period and that was caused by the Client himself or by third parties to whom the Client gave access to the property. Any damage to the property and/or to the things therein present which occurs during the period of the booking must be reported immediately to AffittaSardegna, the Owner and/or his representative. The security deposit will be returned at the time of departure after the property has been checked, at the same time as the property is handed back to the person in charge and after deduction of the expenses for any breakage or damage caused to the property or furnishings. Should the departure not be communicated in time, or should it take place at times which do not allow the person in charge to go to the property to collect the keys from the Client and to check the property, the security deposit will be returned within 2 working days by post/cash transfer, the Iban details of which the Client will inform AffittaSardegna by email.
If, at the time of delivery, the property is not in the state described in the relative accommodation sheet on www.affittasardegna.it and does not allow normal use, or if damage is suffered during the stay, this must be reported within 24 hours to AffittaSardegna. If the reports are not made within this period, the alleged shortcomings of the property shall be deemed unfounded and the Client may subsequently be held liable, with the subsequent demand for payment of any damages. Similarly, should the deficiencies become apparent during the course of the stay. AffittaSardegna cannot constantly guarantee the presence or functioning of all the small accessories or services present in the house at the beginning of the season, by way of example but not limited to: deckchairs, small electrical appliances, mosquito nets, remote controls, antennas, televisions, etc. Although the property is in perfect condition and provided in perfect hygienic conditions, AffittaSardegna is not able to prevent the possible access of animals or insects during the stay. Claims related to the threat of bad reviews or defamation will be prosecuted according to the law. Any untimely complaint reported at the end of the stay or after departure will have no value and will not be taken into consideration. Since AffittaSardegna observes closing days and times, reports after 1.00 p.m. go to the afternoon opening, then to 3.30 p.m.; those after 7.30 p.m. go to 9.00 a.m. the following day. Working days do not include Saturdays and Sundays.
The information and photos on the website www.affittasardegna.it are checked and updated periodically. However, AffittaSardegna cannot guarantee, under any circumstances, the total accuracy of the same; the information contained on the site is presented purely for information purposes and does not in any way constitute a contract with AffittaSardegna. All information may be changed, corrected or removed without notice. AffittaSardegna has no responsibility in the following cases, by way of example only:
In the descriptions of the houses, many household appliances are presented, such as washing machines, dishwashers, air conditioning, televisions, satellite systems, etc., but only the refrigerator, hob and water heater are considered essential to the enjoyment of the booked accommodation. Other household appliances, in the event of breakdown/breakage, are repaired within the limits of the availability of parts and skilled labour. In the event of a breakdown/breakage, the owner is notified first and the intervention of a technician is requested as urgently as possible. In fact, by law, AffittaSardegna is not entitled to carry out technical interventions; for this reason it turns to local craftsmen or service companies specialising in the various technical areas. It will be the care and interest of AffittaSardegna to close the issue as soon as possible. The intervention times are 24/72 working hours (therefore excluding Saturdays and Sundays) and subject to the availability of technicians or material to repair the fault. During the summer, parts can take up to weeks to arrive in Sardinia, so the owner and AffittaSardegna cannot guarantee the functionality of non-essential appliances. Repairs are the responsibility of the owner of the property, unless they are directly attributable to the Client for incorrect use of the property. The Client undertakes to use the property with care and shall be responsible for any breakages or shortages attributable to him/her; breakdowns and breakages must in any case be promptly reported to AffittaSardegna. Upon delivery, the breakdowns caused by the Client and ordinary management and maintenance work (clogging of WCs and sinks, detachment of sockets, damage to equipment or to the property, stained mattress covers and/or pillow covers and/or bedspreads, broken crockery, etc.) shall be charged to the Client and the amounts withheld directly from the security deposit. In doubtful cases or those which have yet to be fully defined, the person in charge of AffittaSardegna will deduct the full amount of the repair from the security deposit and will return the difference, if any, together with the receipt of the expenses incurred for the repair at a later date. In case of repairs/maintenance, the staff of AffittaSardegna, the owner or his representative/charged person, external technicians are, as of now, authorised by the Client during the period of stay to enter the property for inspections or necessary interventions.
Upon handing over the keys of the booked property, the Client is obliged to pay the sum indicated in the Voucher for cleaning. The accommodation is handed over clean and tidy; the Client is obliged to return the accommodation clean and tidy as found on arrival and for this he/she shall wash crockery and kitchen utensils (pots, saucepans, grills, frying pans, cutlery, glasses, plates, etc.); empty, wash and switch off the refrigerator and leave its door open; wash the oven; remove any leftover food or groceries made during the stay from the shelves/furniture; switch off the water heater; empty all containers relating to the separate collection of rubbish, taking away all rubbish in accordance with the rules of the municipal solid waste collection; put away any furniture moved during the stay. Dishes and other equipment in the house (chairs, blankets, etc.) must not be used or carried outside the house. It is compulsory to use at least one sheet between the mattress and the person, failure to do so may result in charges for washing mattress covers and/or bedspreads. Any non-compliance will result in charges assessed on a case-by-case basis by the AffittaSardegna representative and deducted from the deposit. By way of example only:
In some properties pets are not allowed; the Client, at the moment of the booking request, is required to verify, by contacting AffittaSardegna, the possibility that the property you intend to book can accommodate the pet you wish to bring and the relative additional cost of the stay. If the Client shows up with an animal which was not declared at the moment of the booking request (or is introduced into the property in the following days), AffittaSardegna can refuse to hand over the keys and will have the right to keep all the sums paid by the Client (in the case of subsequent introduction of the animal, AffittaSardegna can demand the immediate evacuation of the property and will have the right to keep all the sums paid by the Client). The Owner of the property and AffittaSardegna do not assume any commitment or responsibility in relation to the circumstance that pets have previously stayed in the property the Client wishes to book (or has booked) or that there are other animals in the neighbouring properties. AffittaSardegna and the Owner cannot be held responsible for any allergic reactions that may occur to the occupants of the property booked, limiting themselves to the ordinary cleaning provided for the property at the beginning of the stay. Even in holiday areas, guests may be exposed to noise from construction work, traffic and the like. Neither the Owner of the property nor AffittaSardegna can be held responsible for disturbances caused by noise. If the property booked is equipped with a swimming pool, the Client, for safety reasons, is obliged to follow all the instructions regarding the use of the swimming pool given by the Owner of the property, by AffittaSardegna and by condominium regulations. The Client is fully responsible for the use of the swimming pool for himself and for the persons accommodated with him during his stay. It is forbidden for minors under 18 years of age to use the pool without the supervision of an adult.
All cancellations and changes must be communicated in writing by the Customer and follow the cancellation penalties of the tariff conditions signed at the time of booking.
Cancellations made by the Customer for bookings confirmed with the STANDARD RATE shall incur the following penalties, always calculated on the entire amount of the stay:
- 20% of the amount if the cancellation is communicated up to 91 days before the start date of the stay;
- 50% of the amount, if the cancellation is communicated 31 to 90 days before the start date of the stay;
- 100% of the amount: no refund for cancellations received within 30 days prior to the start date of the stay.
For the purposes of penalties, the entire stay is understood to be a single period that cannot be broken down into individual weeks; the reference date for counting days is always that of the start of the stay, regardless of the period cancelled; changes of period or accommodation are considered cancellations and therefore the relevant penalties will be applied. To cancel a reservation, the customer must send an email to info@affittasardegna.it , indicating the reservation number and the name of the person who made the reservation. Cancellations by telephone are not permitted.
After 24 hours from the non-arrival and in the absence of written communication received by AffittaSardegna, the reservation shall be considered cancelled.
In accordance with point 10, if the cancellation is due to express will or serious neglect that does not allow the use of part or all of the stay, the sums paid shall be refunded in part or in full depending on the period of use, excluding any other refund for moral or material damage that the Customer claims to have suffered. The Customer is aware that the consumer's right of withdrawal is not provided for contracts concluded at a distance pursuant to Legislative Decree 206/2005 and subsequent amendments (Consumer Code) insofar as it is not applicable for services concerning leisure time where the contract provides for a specific date or period of performance, as in the case of Telephone Reservations or Online Reservations.
For any dispute relating to bookings made on the www.affittasardegna.it portal, the exclusive jurisdiction of the Court of Sassari is agreed and accepted.
